Terms and Conditions
1. Free Trial & Subscription
1.1 New users are entitled to a 7-day free trial of the Off-Market Property Portal, which includes full access to all features and property listings.
1.2 The member acknowledges that properties listed on the portal may or may not be available at the time of enquiry or connection. We take no responsibility for the availability of any property. No refunds will be provided in the event a property is no longer available, however we take all reasonable steps to keep listings as current and accurate as possible.
1.3 You may cancel at any time during the trial period to avoid charges.
1.4 If you do not cancel within the trial period, your subscription will automatically continue at $99 per month until cancelled.
1.5 If you request to be connected with a selling agent or seller for any property during the free trial, your free trial will end immediately. By requesting this connection, you agree to commence a paid subscription at $99 per month.
1.6 Once connected, your $99 per month membership will begin from the date you are charged.
1.7 To cancel, you must do so via the Off-Market Property Portal or by emailing info@thepropertysource.com.au.
1.8 Receipts for monthly subscription fees will not be emailed and will be available for download directly from the portal.
1.9 No refunds will be provided if you fail to cancel before the end of your free trial or for any unused portion of your subscription.
2. Limitation of Liability
2.1 While we make every effort to ensure accurate property information, we do not guarantee the completeness, reliability, or suitability of any listing.
2.2 We are not liable for any loss or damage arising from the use of the portal or reliance on any information provided.
3. Privacy
3.1 Any personal information you provide will be handled in accordance with our Privacy Policy.
3.2 By using the portal, you consent to the collection and use of your information for property listings, communications, and related services.
4. Amendments to Terms
4.1 We reserve the right to update or change these Terms & Conditions at any time.
4.2 Continued use of the portal after changes constitutes acceptance of the updated terms.
5. Client Status
5.1 By subscribing, you are considered a client of the Off-Market Property Portal.
5.2 This portal is a platform through which we present off-market properties to our clients.
6. Off-Market Property Status
6.1 We take all reasonable efforts to ensure that properties listed on the portal are off-market properties.
6.2 Our definition of an off-market property is a property that is not listed on publicly available mainstream real estate listing platforms.
6.3 There may be times when an off-market property becomes an on-market property.
6.4 We do our best to remove on-market properties from the portal in a timely manner, but we do not guarantee immediate removal.
7. Relationship to Sellers
7.1 We do not hold the listing authority for any of the properties listed on the portal.
7.2 We do not receive any payment, commission, or benefit from the seller or selling agent.
7.3 All fees and payments are made by the buyer, who is the client of the Off-Market Property Portal.
7.4 Any property transaction facilitated through the portal is treated as a Buyer's Agency transaction.
8. Service Separation
8.1 The Off-Market Property Portal is separate from our standard Buyer's Agency services.
8.2 Engaging with the portal does not include the full scope of our Buyer's Agency service unless separately agreed.
9. Termination of Access
9.1 We reserve the right to suspend or terminate your access to the portal at any time if:
- (a) You fail to pay your subscription or any fees due;
- (b) You breach these Terms & Conditions;
- (c) You misuse the portal or act in a way that may harm other users or the integrity of the portal.
9.2 Upon termination, you will lose access to all portal features and content, and no refunds will be provided for any remaining subscription period.
